Terms of service

These Terms and Conditions (Terms) govern the business relationship between we.fit AG (hereinafter "Provider") and its B2B customers (hereinafter "Buyer"), who purchase dietary supplements via the online shop.

1. Scope of Application

These Terms apply to all orders, deliveries and services made via the online shop of we.fit AG by commercial customers (B2B). By placing an order for products, the Buyer agrees to these Terms.

2. Contract Formation

The purchase contract is concluded once the Buyer receives an order confirmation by e-mail. The order confirmation does not constitute acceptance of the offer, but merely informs of the receipt of the order. The Provider reserves the right to reject orders without providing reasons.

By placing an order on the online shop, the customer accepts the transfer of their customer data and order history from edubily.de to the online shop edubily.ch. The customer agrees to this transfer of data.

3. Prices and Payment Terms

• All prices are stated in Swiss francs (CHF) and exclude value added tax and shipping costs.

• The Provider reserves the right to change prices at any time. For the products ordered by the Buyer, the prices displayed at the time of order apply.

• Payment is by invoice, credit card or other payment methods offered in the online shop. Invoices must be paid within 30 days from the invoice date.

4. Delivery Terms

• Deliveries are made exclusively to addresses in Switzerland and the Principality of Liechtenstein.

• Delivery times are stated on the Provider's website but may vary. The Provider is not liable for delivery delays caused by the shipping service provider or unforeseen circumstances.

• Should a product be unavailable, the Buyer will be informed immediately. In such a case, the Buyer may either withdraw from the purchase or select an alternative product.

5. Risk Transfer

Upon handover of the goods to the shipping service provider, the risk of loss or damage to the goods passes to the Buyer.

6. Right of Return

• The provisions of the Returns Policy apply, according to which only unopened and undamaged products will be accepted for return within 10 days of receipt.

• Return shipping costs are to be borne by the Buyer.

7. Warranty and Liability

• The Provider warrants that the products sold possess the assured properties and are fit for the intended use.

• The warranty period is 6 months from the date of delivery.

• The Provider is liable only for damages caused by gross negligence or wilful misconduct. Further liability, in particular for consequential damages, is excluded.

8. Data Protection

The Provider undertakes to treat the Buyer's personal data confidentially and to use it only for the processing of the order. The provisions of the Privacy Policy, which can be viewed on the Provider's website, apply.

9. Amendments to Terms

The Provider reserves the right to amend these Terms at any time. Amendments will be published on the website and take effect upon publication. For orders already placed, the Terms in effect at the time of order apply.

10. Applicable Law and Jurisdiction

 • Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

• Jurisdiction for all disputes arising from or relating to this contract is the registered office of the Provider.
